「安達人壽香港|了解您的人生規劃需要」推廣活動條款及細則
1. 本「安達人壽香港|了解您的人生規劃需要」推廣活動 (以下簡稱「推廣活動」)是指由安達人壽香港保險香港有限公司(「安達人壽香港」)不時單獨主辦,或與一個或多個安達人壽香港的業務合作夥伴(「業務合作夥伴」)合辦之名為「安達人壽香港|了解您的人生規劃需要」的問卷調查推廣活動。本推廣活動將通過不同業務合作夥伴在各種渠道或平台上進行推廣,包括但不限於業務合作夥伴的網站、營銷通訊(包括但不限於信件、電子郵件、文字短訊、多媒體短訊)、移動應用程式及社交媒體平台。
2. 本推廣活動由 2025 年 7 月 1 日起開始,並將持續至安達人壽香港根據本條款及細則第22條終止為止(「推廣期 」)。不同業務合作夥伴在不同渠道或平台上使用的推廣期可能會有所不同,且可能比推廣期更短或相同。
3. 參加者參與本推廣即被視為已符合本條款及細則第4條所述的參加資格,並已閱讀、理解並同意:
(a) 安達人壽香港的隱私政策和個人資料收集聲明(用於營銷用途);及
(b) 受本條款及細則約束。
4. 本活動僅適用於符合以下所有參加資格的參加者(「合資格參加者」):
(a) 年滿18歲或以上;
(b) 持有有效的香港身份證;
(c) 持有有效的香港手提電話號碼;
(d) 持有有效的電郵地址;
(e) 未曾參加過任何由安達人壽香港主辦或合辦的問卷調查推廣活動;及
(f) 並非安達人壽香港現有的保單持有人。
為免生疑問,任何人士在參加本推廣活動時持有有效的安達人壽香港保單,將不符合參加本推廣活動的資格。安達人壽香港保留核實參加者資格的權利。
5. 在推廣期間,成功通過安達人壽香港指定連結登記個人資料、填寫及提交標題為「安達人壽香港|了解您的人生規劃需要」的線上問卷(「問卷」)的合資格參加者,將可免費獲贈指定獎賞(「指定獎賞」)。
6. 指定獎賞數量有限,並以先到先得的方式送出。指定獎賞的性質和價值可能因推廣活動的渠道或平台及/或涉及的業務合作夥伴而有所不同。
7. 每位合資格參加者僅可參加本推廣活動一次,並僅可獲得一份指定獎賞。為免生疑問,在推廣期間內,已於推廣期間透過任何推廣渠道或平台提交相同問卷的參加者,將不可再次參加本推廣活動。
8. 維特健靈健康產品有限公司(「維特健靈」)擬轉移參加者於活動過程中所提交的姓名、電話號碼、電郵地址、背景資料、指定問題答案及參加記錄(「個人資料」)至安達人壽香港,以便安達人壽香港根據其私隱政策及個人資料收集聲明(用於促銷目的)使用參加者的個人資料直接促銷安達人壽所提供的保險產品及服務之用。 維特健靈會因該轉移而獲得金錢或其他財産的回報。但是,在未得到參加者對該轉移所提供的書面同意的情況下,維特健靈不能轉移參加者的有關資料予安達人壽香港作直接促銷之用。如參加者其後決定不欲接受安達人壽香港的直接促銷、或要求查閱/更正個人資料,請以書面形式向安達人壽香港的資料保護主任提出,並送交至香港銅鑼灣告士打道311號皇室大廈安達人壽大樓35樓。就處理查閱個人資料要求或需收取合理費用,至於更正個人資料方面,若合乎更改要求則毋須支付任何費用。有關安達人壽香港的私隱政策,請參閱:https://www.chubb.com/hk-zh/footer/chubb-life-privacy-policy.html。有關安達人壽香港的個人資料收集聲明(用於促銷目的) ,請參閱:https://www.chubb.com/content/dam/chubb-sites/chubb/hk-en/pdf/chubb_life_hk_personal_information_collection_statement_for_marketing_purposes.pdf。
9. 問卷中提供的資料一經提交,均不可更改或取消。如問卷中所要求的任何個人資料(包括但不限於姓名、手提電話號碼及/或電郵地址)重複使用、不正確、不真實、不完整或無效,相關參加者將被取消參加資格。如手提電話碼及/或電郵地址在之前提交的問卷中已被使用,該手提電話號碼及/或電郵地址將不可再次被提交。參加者不得異議。
10. 若問卷被重複提交,僅首次提交的問卷將被視為有效。為免生疑問,如使用不同設備、以不同渠道或平台、或透過不同業務合作夥伴,或以其他任何方式重複提交問卷,則僅首次提交的問卷將被視為有效。以安達人壽香港電腦系統的記錄為準。
11. 安達人壽香港及業務合作夥伴(如適用)對於提交、接收或處理問卷或與本推廣活動有關之任何其他通訊的任何傳輸錯誤、延遲、中斷或故障概不負責。
12. 指定獎賞將由安達人壽香港或業務合作夥伴(視情況而定)通過電郵地址或其他渠道發送給合資格參加者。由於指定獎賞的實際交付時間及方法可能因推廣活動的渠道或平台及/或涉及的業務合作夥伴而有所不同,請參閱推廣頁面及/或成功提交問卷後發送給合資格參加者之確認電郵以了解具體詳情。
13. 安達人壽香港及業務合作夥伴(如適用)不負責因任何電腦、網路、電話、其他技術問題或任何屬於其控制範圍以外之理由,或因資料延遲、遺失、錯誤、無法辨識或損壞而導致指定獎賞未能送達的情況。參加者不得異議。
14. 指定獎賞不可退還、轉讓/轉售、退換或兌換現金或任何其他物品/服務。若因任何原因丟失、過期或失效,指定獎賞將不可更換或補發。
15. 安達人壽香港保留以其他獎品代替指定獎賞的權利而不作事先通知。用於代替之獎品的價值及/或性質可能與指定獎賞有異。
16. 指定獎賞的提供及使用受相關第三方提供者不時規定之條款及細則約束。任何有關指定獎賞及其相關服務的查詢或投訴應直接向相關第三方提供者提出。合資格參加者應自行安排兌換或使用指定獎賞,安達人壽香港不承擔任何責任。
17. 安達人壽香港非指定獎賞的供應商,對於因指定獎賞而產生的任何問題(包括但不限於其數量、質量、適用性及可用性)不承擔任何義務或責任。
18. 安達人壽香港對於參加者因技術或其他限制或不可抗力事件(包括但不限於監管政策、政府指令、政府干預、疫情、活動限制、自然災害等)而無法參加本推廣活動不承擔任何責任。
19. 如本推廣活動的宣傳資料中所包含的資訊與本條款及細則有任何衝突,則以本條款及細則為準。本推廣活動相關資料中所包含的任何商標、圖像、標誌或服務標誌之知識產權均為其各自擁有者的財產。
20. 若本條款及細則的任何條款被有關管轄權的法院認定為無效,則該(等)條款的無效不應影響其餘條款的有效性,本條款及細則中的其它條款仍應完全有效。安達人壽香港未有行使本條款及細則下的任何權利或補救措施,將不構成放棄該等權利或補救措施。
21. 本條款及細則受香港法律所管轄並按照其詮釋。因本條款及細則所引發的或相關的任何事項、索償或爭議,參加者及安達人壽香港不可撤回地同意接受香港法院的專有司法管轄權。
22. 除安達人壽香港及合資格參加者以外,沒有任何人士有任何權利按《合約(第三者權利)條例》(香港法律第 623 章) 強制執行本條款及細則的任何條文。
23. 安達人壽香港保留以下事宜的最終決定權:
(a) 變更、暫停或終止本推廣活動,恕不作提前或另行通知;
(b) 在不需要提供任何理由的情況下取消任何參與者的資格;及
(c) 修訂本條款及細則,恕不作提前或另行通知。
24. 安達人壽香港對本條款及細則擁有絕對解釋權。如有任何爭議,安達人壽香港將擁有最終決定權。
25. 本條款及細則的中英文文本如有不一致,概以英文文本為準。
“Chubb Life Hong Kong – Understanding Your Life Planning Needs” Campaign Terms and Conditions
1. This "Chubb Life Hong Kong - Understanding Your Life Planning Needs" Campaign (“Campaign”) refers to the survey campaign(s) titled “Chubb Life Hong Kong – Understanding Your Life Planning Needs”, which may be organized solely by Chubb Life Hong Kong Insurance Hong Kong Limited ("Chubb Life Hong Kong") or in collaboration with one or more business partner(s) of Chubb Life Hong Kong (“Business Partner(s)”) from time to time. This Campaign will be promoted through various channel(s) or platform(s) by different Business Partner(s), including but not limited to the Business Partner(s)’ website(s), marketing communication(s) (including but not limited to letter(s), email(s), SMS, MMS), mobile application(s) and social media platform(s).
2. This Campaign starts from July 1, 2025 and will continue until it is terminated by Chubb Life Hong Kong pursuant to clause 22 of these terms and conditions ("Campaign Period"). The promotion period used by different Business Partners in different channels or platforms may vary and can be shorter than or same as the Campaign Period.
3. By participating in this Campaign, the participants are deemed to have fulfilled the eligibility criteria stated in clause 4 of these Terms and Conditions, and have read, understood and agreed to:
(a) Chubb Life Hong Kong’s Privacy Policy and Personal Information Collection Statements for Marketing Purposes; and
(b) be bound by these Terms and Conditions.
4. This Campaign is only applicable to the participants who fulfil all the following eligibility criteria (“Eligible Participants”), i.e. who:
(a) is at age 18 or above;
(b) holds a valid Hong Kong Identity Card;
(c) has a valid Hong Kong mobile number;
(d) has a valid email address;
(e) has not participated in any survey campaign(s) solely or jointly organized by Chubb Life Hong Kong before; and
(f) is not a current Chubb Life Hong Kong policyowner.
For the avoidance of doubt, any individual who holds a Chubb Life Hong Kong in force policy at the time of participating in this Campaign shall be ineligible to enter this Campaign. Chubb Life Hong Kong reserves the right to verify the eligibility of the participants.
5. The Eligible Participants who successfully register their personal information as well as complete and submit an online questionnaire titled “Chubb Life Hong Kong – Understanding Your Life Planning Needs” (“Questionnaire”) through a designated link of Chubb Life Hong Kong during the Campaign Period will be eligible to receive a designated reward ("Designated Reward") for free.
6. The Designated Reward is offered on a limited quota and a first-come, first-served basis. The nature and value of the Designated Reward may vary depending on the channel or platform used for promoting the Campaign and/or the Business Partner(s) involved.
7. Each Eligible Participant can only participate in this Campaign once and receive only one Designated Reward. For the avoidance of doubt, participant(s) who have previously submitted the same Questionnaire within the Campaign Period, regardless of the promotional channel or platform, are not eligible to participate in the Campaign again.
8. Vita Green Health Products Company Limited("Vita Green") intends to transfer the name, phone number, email address, background information, specific question answers, and participation records ("Personal Data") submitted by participants during the event to Chubb Life Hong Kong. This is to enable Chubb Life Hong Kong to use the participants' personal data for direct marketing of insurance products and services offered by Chubb Life Hong Kong, in accordance with its Privacy Policy and Personal Information Collection Statement for Marketing Purposes. Vita Green will receive monetary or other property rewards for this transfer. However, without obtaining written consent from the participants for this transfer, Vita Green cannot transfer the participants' data to Chubb Life Hong Kong for direct marketing purposes. If participants later decide not to receive direct marketing from Chubb Life Hong Kong, or wish to access/correct their personal data, they should submit a written request to the Data Protection Officer of Chubb Life Hong Kong and send it to 35/F, Chubb Tower, Windsor House, 311 Gloucester Road, Causeway Bay, Hong Kong. A reasonable fee may be charged for processing requests to access personal data, but no fee will be charged for correcting personal data if the correction request is justified. 9. All information provided in the Questionnaire cannot be changed or cancelled once being submitted. If any requested personal information in the Questionnaire including but not limited to the name, mobile number and/or email address provided is/ are repeatedly used, incorrect, untrue, incomplete or invalid, the relevant participant will be disqualified for this Campaign. If the mobile number and/or email address has previously been used in any previous submitted Questionnaire, such mobile number and/or email address are not allowed to be resubmitted again. Participants shall not have any objection.
10. In the event of repeated submissions of the Questionnaire, only the first submission will be considered as valid. For the avoidance of doubt, in the event of repeated submissions of the Questionnaire using different devices, or through different channels or platforms, or through different Business Partners, or in any other means, only the first submission will be considered as valid. The records in Chubb Life Hong Kong’s computer system are final.
11. Chubb Life Hong Kong and the Business Partner(s) (if applicable) are not responsible for any transmission errors, delays, interruptions, or failures in the submission, receipt, or processing of the Questionnaire or any other communications related to the Campaign.
12. The Designated Reward will be sent by Chubb Life Hong Kong or the Business Partner(s) (as the case may be) to the Eligible Participants via the email address or other channels. As the actual delivery timeline and method of the Designated Reward may vary depending on the channel or platform used for promoting the Campaign and/or the Business Partner(s) involved, please refer to the promotional page and/or the confirmation email sent to the Eligible Participant upon successful submission of the Questionnaire for the exact details in respect thereof.
13. Chubb Life Hong Kong and the Business Partner(s) (if applicable) are not liable for failure in delivering the Designated Reward to Eligible Participants due to any computer, network, telephone, or other technical issue(s), or other reasons beyond its/ their control, or due to delay, loss, error, unrecognition or damaged data. Participants shall not have any objection.
14. The Designated Reward cannot be returned, transferred/ resold, exchanged or redeemed for cash or any other items/ services. No replacement or reissuance of the Designated Reward if it is lost, expired or invalidated for whatsoever reasons.
15. Chubb Life Hong Kong reserves the right to replace the Designated Reward with alternative gift without prior notice. The value and/or nature of the alternative gift may differ from that of the Designated Reward.
16. The provision and use of the Designated Reward is subject to the terms and conditions as determined by the relevant third-party provider(s) from time to time. All enquiries or complaints regarding the Designated Reward and any services in relation thereto should be directed to the relevant third-party provider(s). Eligible Participants are responsible for making their own arrangement for redeeming or using the Designated Reward, and Chubb Life Hong Kong shall not be responsible and / or held liable whatsoever.
17. Chubb Life Hong Kong is not the supplier of the Designated Reward and shall have no obligations or liabilities in any issues that arise from the above services (including, without limitation, their quantity, quality, fitness, and availability) provided.
18. Chubb Life Hong Kong is not liable for any inability of participants to participate in this Campaign due to technical or other limitations or force majeure events, including but not limited to regulatory policies, government directives, government interventions, epidemics, activity restrictions, natural disasters, etc.
19. If there is any conflict between the information contained in the Campaign materials of the Campaign and these Terms and Conditions, these Terms and Conditions shall apply and prevail. Any trademarks, images, logos or service marks contained in any material related to this Campaign are the intellectual property of their respective owner(s).
20. If any provision of these Terms and Conditions is found to be invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. The failure of Chubb Life Hong Kong to exercise any right or remedy under these Terms and Conditions shall not constitute a waiver of such right or remedy.
21. These terms and conditions are governed by and shall be construed in accordance with the laws of Hong Kong. The Participants and Chubb Life Hong Kong hereby irrevocably agree to submit to the exclusive jurisdiction of the courts of Hong Kong in relation to any matter, claim, or dispute arising out of or in connection with these terms and conditions.
22. No person other than Chubb Life Hong Kong and the Eligible Participants will have any right under the Contracts (Rights of Third Parties) Ordinance (Cap.623) to enforce any provision of these terms and conditions.
23. Chubb Life Hong Kong reserves the right to:
(a) vary, suspend or terminate this Campaign without prior or further notice;
(b) disqualify any participants without having to provide any reasons; and
(c) amend these Terms and Conditions without prior or further notice.
24. Chubb Life Hong Kong reserves the right to interpret these Terms and Conditions. In case of any disputes, Chubb Life Hong Kong’s decision shall be final and conclusive. The decision of Chubb Life Hong Kong on all matters and disputes relating to this promotion shall be final and conclusive.
25. In the event of any inconsistency between the English and Chinese versions of these terms and conditions, the English version shall prevail.
